These Terms and Conditions (the “Terms”) form a binding agreement between you and AutoVanish LLC (“AutoVanish,” “we,” “us,” or “our”) governing your access to and use of our websites, forms, communications, vehicle-evaluation and offer services, pickup coordination, payment coordination, and related services (collectively, the “Services”).

If you do not agree to these Terms, do not use the Services or submit information to AutoVanish. Our Privacy Policy and any disclosures presented during the offer or transaction process are incorporated into these Terms by reference.

You must be at least 18 years old, reside in the United States, and have legal capacity to enter into a binding agreement. You may submit a vehicle only if you are its lawful owner or have valid authority from the lawful owner to sell and transfer it.

The Services are not directed to children under 13, and individuals under 18 may not submit a vehicle or accept an offer.

AutoVanish currently purchases and picks up vehicles in California. We may decline, refer, or cancel a request for a vehicle located outside our service area.

Leased vehicles, vehicles with an outstanding loan or lien, abandoned vehicles, motorcycles, RVs, boats, and individual parts are generally not eligible. If you are not sure whether your vehicle qualifies, submit it anyway and we will tell you.

AutoVanish provides a convenient process for vehicle owners to submit vehicle information and receive potential purchase offers. Depending on the transaction, AutoVanish may act as a prospective buyer, facilitate an offer from a partner buyer, or coordinate services with third-party buyers, towing providers, transportation providers, payment providers, and other service providers.

Submitting a vehicle does not guarantee an offer, a particular price, a completed sale, or pickup. We may request additional information, photographs, documents, inspections, or verification before presenting or finalizing an offer.

Unless expressly stated otherwise in a final written purchase document, offers are preliminary, revocable, and conditioned on verification of the information you provide. An offer may be changed or withdrawn if the vehicle, title, ownership, mileage, location, parts, condition, damage, or other material facts differ from the submitted information.

Offer availability and value may also be affected by market conditions, towing access, local requirements, documentation, liens, partner availability, and the time that passes before acceptance or pickup. You may accept or decline an offer without obligation unless you have separately entered into a binding purchase agreement.

An accepted offer is honored at pickup when the vehicle, its documentation, and its location match the information you provided. Unless a different period is stated when the offer is made, an offer expires three (3) days after it is sent. After it expires, you may request a new offer, which may differ from the original.

You represent and warrant that all information you provide is accurate, complete, current, and not misleading. This includes information about:

• year, make, model, trim, VIN, mileage, and vehicle location;
• whether the vehicle starts, drives, rolls, steers, and brakes;
• missing, replaced, damaged, burned, flooded, or deployed components;
• accidents, title brands, liens, loans, theft history, and ownership issues;
• keys, tires, wheels, catalytic converter, battery, engine, transmission, and other material parts; and
• any fact that could affect value, safe pickup, or legal transfer.

You must promptly correct information that becomes inaccurate before pickup or payment.

You must provide documentation sufficient to establish identity, ownership, authority to sell, and the ability to transfer the vehicle as required by applicable law and the final buyer. Requirements vary by state and transaction.

You must disclose all liens, loans, title defects, probate issues, co-owners, missing signatures, title brands, and other transfer restrictions. AutoVanish or a partner may decline, delay, or condition a transaction until all required documentation is verified and any liens or ownership issues are resolved.

Do not upload documents belonging to another person unless you have authority to provide them.

You are responsible for completing the transfer documents required by your state, including any signed title, bill of sale, or odometer disclosure, and for submitting any seller notice your motor vehicle agency requires.

In California, the seller must submit a Notice of Transfer and Release of Liability to the DMV within five (5) days of the sale. This notice protects you from responsibility for parking citations, toll violations, and other matters that arise after the vehicle leaves your possession. Where permitted, remove license plates, toll transponders, and personal items before pickup.

AutoVanish and partner buyers may help you with paperwork at pickup but do not file the Notice of Transfer and Release of Liability on your behalf unless expressly agreed in writing.

The vehicle and its documentation may be inspected before or at pickup. The inspection may verify identity, VIN, mileage, ownership, title status, disclosed damage, missing parts, mechanical condition, and safe accessibility.

If inspection reveals a material discrepancy, the buyer may revise or withdraw the offer. You are free to decline a revised offer before completing the sale, subject to any separate written agreement you have signed.

We may share information necessary to evaluate and complete a potential transaction with partner buyers and with providers supporting towing, transportation, communications, document verification, fraud prevention, payments, hosting, and customer service.

In most transactions, the purchaser of your vehicle is a partner buyer selected through AutoVanish’s platform. The partner buyer, a carrier acting on its behalf, or AutoVanish may inspect, pick up, and pay for the vehicle, and the partner buyer may require you to sign additional transaction documents. AutoVanish may receive compensation from partner buyers in connection with a completed transaction.

Partner buyers and towing providers operate under separate agreements with AutoVanish. Third parties are responsible for their own acts and services except to the extent AutoVanish is legally responsible under applicable law.

Pickup dates and time windows are estimates and may change because of driver availability, weather, traffic, safety, documentation, vehicle accessibility, equipment requirements, or events beyond reasonable control.

You agree to provide safe and lawful access to the vehicle, disclose special towing conditions, remove personal property, and have agreed documentation and keys ready. Vehicles must not contain weapons, illegal substances, hazardous materials, waste, or undisclosed personal property.

If you need to cancel or reschedule, contact us as soon as possible. AutoVanish or a partner may cancel or reschedule if information cannot be verified, pickup would be unsafe or unlawful, or the transaction cannot reasonably be completed.

There is no charge to you for cancelling or rescheduling a pickup, and no towing, listing, or processing fees are deducted from an accepted offer. If a pickup cannot be completed because the vehicle, documents, or access differ from what you told us, the buyer may revise or withdraw the offer.

Payment is typically made in cash at pickup, after the vehicle and its documentation have been inspected and verified. Depending on the transaction, payment may be issued by AutoVanish, a partner buyer, a carrier acting on behalf of a buyer, or an approved payment provider, and may instead be made by check, ACH, or another approved electronic method when agreed with you in advance.

Payment is conditioned on final verification of the vehicle, ownership, documentation, transfer requirements, and transaction terms. Timing may depend on banking systems, document processing, fraud review, and confirmation of pickup. You are responsible for providing accurate payment information and for any fees charged by your own financial institution.

By providing contact information, you authorize AutoVanish and service providers acting on our behalf to contact you about your vehicle submission, requested offer, missing information, documents, pricing, scheduling, pickup, payment, customer support, and closely related service matters.

Communications may be made by telephone, SMS/text message, email, or other electronic means and may use automated technology where permitted by law. Message frequency varies. Message and data rates may apply. After a completed transaction, we may send a one-time message inviting you to share feedback or a review of your experience.

We send promotional or marketing messages only if you separately consent to receive them. Consent to receive marketing communications is not a condition of selling a vehicle or obtaining an offer, and you may withdraw it at any time.

You may opt out of SMS messages by replying STOP and request help by replying HELP. Marketing email messages will include an unsubscribe method when required. We may continue sending non-marketing communications necessary to complete or administer a transaction, respond to you, or comply with law.

Calls and messages may be monitored or recorded for quality, training, security, and documentation where permitted by law and subject to any legally required notice.

You may not use the Services to commit fraud, impersonate another person, submit a stolen vehicle, conceal material information, interfere with systems, introduce malicious code, scrape or reverse engineer protected portions of the Services, violate another person’s rights, or engage in unlawful, abusive, or unsafe conduct.

We may investigate suspected misuse, preserve relevant records, cooperate with lawful authorities, and suspend or terminate access when reasonably necessary to protect users, partners, AutoVanish, or the public.

The Website, branding, design, software, text, graphics, and other content are owned by AutoVanish or its licensors and are protected by applicable intellectual-property laws. You may use the Services only for their intended personal or business purpose and may not reproduce or exploit protected content without permission.

You retain ownership of photographs, documents, and other materials you submit. You grant AutoVanish and its service providers a limited, non-exclusive license to host, copy, process, transmit, and display those materials solely as reasonably necessary to provide the Services, evaluate the vehicle, prevent fraud, complete the transaction, keep required records, and comply with law. Separate permission is required before using identifiable customer materials as a public testimonial or advertisement unless otherwise permitted by law.

Photos you submit should show only the vehicle. Do not upload images that identify other people, or documents you are not authorized to share.

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy. California residents and other eligible users may have additional rights described in that policy and in our Privacy Choices page.

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” AutoVanish disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Services will always be uninterrupted, error-free, secure, or available, or that any particular offer or transaction will be completed.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the maximum extent permitted by law, AutoVanish and its officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, business interruption, or loss of data, arising from or related to the Services.

To the maximum extent permitted by law, AutoVanish’s aggregate liability for a claim arising from the Services will not exceed the greater of one hundred dollars ($100) or the amount, if any, you paid directly to AutoVanish for the Services giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless AutoVanish LLC and its owners, employees, contractors, partners, and service providers from and against claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, the information or materials you submit, the vehicle you sell, your breach of these Terms, or your violation of any law or third-party right.

Information provided through the Services, including estimates and offers, is for transaction purposes only and does not constitute legal, financial, tax, insurance, or other professional advice.

AutoVanish uses third-party geographic data to support location-based features such as ZIP code distance and service-area checks. ZIP code data is provided by SimpleMaps and other third-party data providers.

We may restrict or terminate access to the Services, withdraw an offer, or stop a transaction if we reasonably believe these Terms were violated, information is inaccurate, fraud or unlawful activity may be involved, safety is at risk, or continuing the transaction is impracticable.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, limitations of liability, recordkeeping, governing law, and dispute provisions—will survive.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, claims relating to these Terms or the Services will be brought in the state or federal courts serving the location of AutoVanish’s principal California office, and each party consents to those courts’ jurisdiction.

Before filing a claim, you and AutoVanish agree to attempt in good faith to resolve the dispute informally by providing written notice describing the issue and requested resolution. This informal process does not extend any legal limitation period unless agreed in writing.

We may update these Terms to reflect changes in the Services, law, or business practices. Updated Terms will be posted with a revised effective date. Material changes will apply prospectively unless otherwise required by law.

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; AutoVanish may assign these Terms in connection with a merger, financing, reorganization, sale of assets, or similar transaction.

These Terms are written in English. If a translation is provided for convenience, the English version controls.
